These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of such courts.
Before initiating any formal legal proceedings, you agree to first contact us and attempt to resolve any dispute informally. Most concerns can be quickly resolved through direct communication.
If we cannot resolve a dispute informally, you and FREEWYLD LLC agree to resolve any disputes through binding arbitration rather than in court, except for claims that may be brought in small claims court. Arbitration shall be conducted in accordance with the rules of the American Arbitration Association.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after any changes constitutes acceptance of the modified Terms.
We may terminate or suspend your access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use our services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, and limitations of liability.
